skarang is zaman saman menyaman esepecially saman malu.yakni dalam bahasa englandnya adelah defamation.a defamation suit arises frm a situation of convicium adversus bonos mores..atau dalam bahasa adnan sempitnya yg bermaksud; depan orang ramai lu buat statement pasal ex gf lu n lu kata ex gf lu ni minah rempit, takde maruah, n otak sempit mcm beruk kat zoo..
dari politician, artist, artist wanna be, sampai lah ke rakyat jelata..semua nak main mahkamah aje now. dalam isu saman menyaman ni, there are boon and bane. tapi beratnye ke negatif lah. im not sayin takde positif langsung.. dalam berblogging ni u have go to be careful with every word u write, each entry u post and any person u r referring to in ur writings.throughout my years of practice (okay 2 years je pon hahah)..my main portfolio for civil are defamation cases coupled with few injunctiions in the suits.. tapi wa tak hebat mana pon..wa buat kes saman malu menteri ajo (as he was then) lalalalalla...
cumanya, one thing the bloggers should really understand, defamation is an action in jurarum. doesnt matter tht the defamed person suffers any injury to his charactecter, well being in the society or any other losses arising out of the defamatory remark made by another person. dat means the the injury is automatic in nature ie actionable per se..say, u wrote in ur entry "Mekjah (bukan nama sebenar) adalah orang tua kutuk, tak sadarkan diri! perangai seperti perempuan jalanan". the minute u published this entry, and it becomes viable to the public, the damage is done. though mekjah ddid not lose anything consequential to ur published entry. n mekjah can come to me, n seek my advice for her next course of action, and later, i ll bill mekjah, ermm let say RM 1 juta? hahahah..ok laa this is just an example..im no longer in practice pon ok.

anyways, back to saman menyaman in defamation suit, the remedy or relief for the aggrieved party are secured both in law n equity. so klu remedy or relief taht u wanted is not available in law...then equity will squeeze in.
kalau mahu cerita panjang lebar, mungkin nanti anda2 semua akan bosan dan tertidur. dah mcm pergi law lectures pulak kan?
but before i wrap up this entry, being a plaintiff in a defamtion case does not necessarily mean that you are the injured or aggrieved party yet. there are lots of elements need to be proved other than that of the publication itself. wat's more to prove whether the words published are defamatory? the test is always subjective, which appends question of fact. there u go...reasonable man test will come into the picture..but how reasonable is reasonable? that will be another question of fact.
albeit the fact that defamation is actionable per se where injury is assumed and not proved... u ve gotta always remember this.. " he who seeks equity in court must come with clean hands". kang ade plak yg pegi basuh tangan sebelum naik mahkamah.. hehehe.. maka semasa membasuh tangan sebelum pergi court, fikir fikirkan dan renung2kan lah..sebelum u take action against tht person, are you 100% sure that u have not done or published anything before in ur blog entry, facebook, twitter or any other medium viable to the public that initially had defamed or libelled the person u wanted to sue? silap2 kang ade counterclaim beb..tak pasai2 hang termalu alahhhh..laallalalala
aku tulis pasal ni pon bukan psl nak cari pasal dgn sapa2....it is unlikely that most of the bloggers are aware of the result of their publications in blog.. termasuklaa pengkritik2 di blog anda yg turut sama naik syeikh, tidak kira pengkritik tetap atau pngkritik jemputan.. cumanya i ve dealt with lots of cases like this before, n it made me feel tht i have some sort of social responsibility to address on the apprehended issue above to u guys... bukan niat aku nk tunjuk lagak or pandai or perli sesiapa pun.. dalam semua2 kes saman malu yg aku pnah handle, takdak satu pun kes dimana jumlah gantirugi yg dipohon is less than 1million.. so berhati2lah dalam berblogging, bertwitter dan ber fb.. walaupun dunia kini adalah tanpa sempadan, jadilah insan yang bijak membataskan percakapan. if u've got nothing good to say, then say nothing at all..

setelah dikaji dan disemak2 semula, sy berpendapat bhw komen sis tijah tiada unsur2 fitnah yg merujuk kepada pihak2 tertentu. jadi lembaga penapisan blog ini berpendapat bhw komen anda layak untuk di approve.
nak tanya in detail lagi boleh? or with the law yg sedia ada, what sort of rules for a blogs writer to follow? banyak kah? abis kalau cursing all the way? camano?

actually bnyk je relevant law yg terpakai untuk blogger..for instance i could only name few of the like infringement law, copyright, defamation, computer crimes act, communication and multimedia act, publication act..
and sebenarnya, blog ni is a medium of publication just like newspapers, tv and radio. so most of the relevant regulations applicable to tv, newspaper n radio are also applicble to blogs and blogwritings.
mcm cursing tu plak, that will be under defamation law. cursing tak salah..but to make reference of someone in your curse is defamatory. let say u just nak cakap u hate diva blogger sbb berlagak kencang and bagus..that is just a general statement.. the same goes to "all lawyers are liars".
but let say u pinpoint someone though tak sebut nama hence sebut her character or anything tht can relate to her and it is well known to everyone in the blogging world tht "she" is the person u meant in your curse, tu dah jadi defamatory.
this is just a simple note je dear..it's more complicated actually..
